At Fruit Trees Only, we are committed to delivering exceptional service from the moment you select your tree to the moment it’s thriving in your landscape. We offer flexible and reliable installation options, available seven days a week to accommodate your schedule — because we know your time matters.
Whether you place an order by phone or handpick your trees in person at our garden center, you can choose from same-day, next-day, or two-day delivery and installation, all offered for a modest service charge.
We believe that knowing what to expect is just as important as the product itself. Whether you're receiving potted fruit trees, flowering plants, or gardening materials, our team ensures every installation service is scheduled to meet your demanding schedule, conducted professionaly, and carefully handled.
Terms of Service for Plant Installation Services
Effective Date: January 1, 2025
These Terms of Service (“Terms”) govern all plant installation services (“Services”) provided by Fruit Trees Only (“Company,” “we,” or “us”) to the customer (“Client” or “Homeowner”) and are in addition to our general website and sales terms. By scheduling or accepting plant installation services, the Client agrees to the following:
1. Call Before You Dig (811) - Utility Marking Requirement
Before any plant installation can occur, the Client is required to contact Florida’s 811 service (“Sunshine 811”) to have all underground utility lines marked. This service is free and can be reached by dialing 811 at least 2 full business days prior to installation. This requirement applies to all services provided in St. Johns County, Florida, and may apply in other service areas as well. It is the Client’s responsibility to ensure utility marking has occurred and that visible utility markings are present on the property before work begins. If utility marking has not been completed, we reserve the right to reschedule or cancel installation without penalty to the Company.
2. Client Responsibilities - The Client agrees to:
- Be present during the installation window in case special instructions or care are required.
- Provide accurate and up-to-date property access information.
- Ensure the driveway or designated delivery area is accessible and free of obstructions.
- Provide a safe and accessible delivery area.
- Notify us of any gates, animals, or obstacles that could prevent safe installation.
- Contact Sunshine 811 / Call before you dig prior to the installation of any plant material
- Provide water source for initial watering at the time of planting
- Failure to do so may result in rescheduling and/or additional fees.
3. Standards of Installation
All plantings are performed according to accepted practices in the Florida agricultural and landscape industry, including: Proper spacing, soil amendments, and mulch Stake and tie (if necessary) Watering at time of installation However, plant performance is influenced by variables outside of our control (e.g., weather, pests, soil conditions, homeowner care). Therefore: No guarantee is expressed or implied for plant health beyond the date of installation unless a separate written warranty is provided. Post-installation care of the newly installed plants is the responsibility of the homeowner.
4. Liability Waiver
While we take every precaution to ensure safe and damage-free delivery:
- The Company is not liable for any property damages.
- The Company is not responsible for pre-existing soil, irrigation, or structural issues on the property.
- The Client assumes full responsibility for verifying local regulations, HOA rules, and easements.
5. Guarantees
Our standard and extended warranties are available for all plant material. However, please note the following:
- No guarantee is expressed or implied for plant health beyond the date of installation unless a separate written warranty is provided.
- Post-installation care of the newly installed plants is the responsibility of the homeowner.
- All ownership of the purchased plant, including but not limited to the care of the plant, is transferred to the owner upon installation.
6. Cancellations & Rescheduling
Clients must provide at least 24 hours notice for cancellations. Missed or last-minute cancellations may be subject to an additional service fee.
7. Changes to Terms
We reserve the right to modify these Terms at any time. The latest version will always be made available on our website or upon request.
